ABETEC respects your privacy

ABETEC processes personal data in accordance with this privacy statement. For further information, questions or comments about our privacy policy, please contact the privacy officer at privacy@abetec.be.
We want to inform the users of our services and website as much as possible and give them control over what happens to their data. Below you will find some more information about our privacy policy and explain what information we collect, why, for how long and how you have control over it.


Who is protected by this policy?

This privacy policy applies when you visit our offices, website and when you are a potential or former customer of ABETEC.
 

What does 'processing of data' mean and who is responsible for it?

By 'processing of data' we mean any processing of personal data. Personal data' are all data that can identify a natural person (see more below). The term 'processing' includes the collection, recording, organisation, storage, updating, modification, retrieval, consultation, use, distribution or in any way making available, bringing together, combining, archiving, erasing or ultimately destroying personal data.
 
ABETEC is responsible for the processing of your personal data.
 

What are the processing purposes?

ABETEC collects and processes customers' personal data for customer and order management (e.g. customer administration, follow-up of orders/deliveries, invoicing, solvency monitoring, profiling and sending marketing and personalised advertising).
 

What data do we process?

Among other things, we process personal data. These are data relating to an identifiable person (the 'data subject') and which

  • you give us yourself;
  • we assign to you for the use of our services;
  • we obtain through the use of services, including use by end users or;
  • we received through third parties.

All data we collect can be combined to optimize our offers and services.

There are different types of personal data:

User information: This allows us to identify you or contact you. For example: your name, address, telephone number, language preference, copy of the front of your identity card, gender, e-mail address, age, family composition and any other preferences you may express through social media, promotions, mobile applications, competitions, etc., including your financial and creditworthiness data;
Technical data: we need these to ensure the proper functioning of our products and services.
Traffic data: We need this special technical data to handle your traffic over electronic communication networks, such as your anonymized IP address or MAC address;
Location data: this data allows us to determine the location of your SIM card. Location information indicates which mast your mobile device or tablet is connected to;
Information about your use: the information we receive when you use our services. Among other things, we use this information to bill you correctly as a customer and to offer you a better and personalised experience.
ABETEC does not process sensitive data such as data about your racial or ethnic origin, political opinions, sexual preferences and health.
 

What are the legal basis(s) of the processing?

Personal data are processed on the basis of Article 6.1. consent,] [(a) consent,] [(b) (necessary to perform a contract),] [(c) (necessary to comply with a legal obligation)], [(f) (necessary to protect our legitimate interest to undertake)] of the General Data Protection Regulation.

Insofar as the processing of personal data takes place on the basis of article 6.1. a) (consent), the customer always has the right to withdraw the consent given].
 

What do we use this data for?

We process personal data for various purposes, each time only those data are processed that are necessary to achieve the intended purpose.

This is how we use personal data:

  • when we have permission;
  • in the context of the preparation or execution of a contract;
  • to comply with the legal or regulatory provisions to which we are subject; and
  • when ABETEC has a legitimate interest in doing so, in which case we always strive to strike a balance between that interest and respect for the privacy of the data subject.

Subject to your consent, to the extent required, we collect personal data for the following specific purposes:

  • To process your request for our services. When you visit our website to collect information about our services or when you sign up for our project sheets, for example, we need your address information. All the information we receive about you at this stage will only be used to provide you with the requested information in the manner you wish.
  • To continue to improve our services. We may process the data about your use in order to evaluate and improve our offer. 
  • To inform you about (new) services of ABETEC. We may use your information to provide you with new services which we think may be of interest to you. You can unsubscribe from these types of messages. You can read how to do this later in this privacy policy.
  • To offer you personalized ads / messages. Your profile allows us to tailor our advertisements / messages to your interests and preferences. You can read more about how to unsubscribe in this privacy policy.
  • To guarantee everyone's safety in and around our office, you can also be filmed by our security cameras. These images are only stored for the safety of goods and persons and to prevent abuse, fraud and other infringements of which our customers, visitors and/or ourselves are victims (we signal the presence of cameras with icons indicating our contact details).
  • To monitor our performance. We may use your information and profile to evaluate our services. This includes: asking for feedback on our services (e.g. through market research), data obtained during conversations or interventions, our answers to customer questions....
  • To comply with our legal obligations. In many cases, we are legally obliged to retain and/or disclose certain personal data to government authorities. Just think of general tax and accounting obligations. In the context of a police or judicial investigation, we may be required to disclose certain information in a confidential manner to the necessary government authorities.
  • To track studies, tests and statistics, including trend analysis. We may use your anonymous, aggregated data to, for example, report internally and externally on the use of our products/services.
  • The information we use in this process cannot be traced back to a particular individual. We use the information we obtain from these analyses to evaluate and adjust our current product and service portfolio and processes.

If you do not wish your data to be processed for marketing purposes, you can report this to ABETEC or via email at abetec@abetec.be.
 
When you use other parties' services through our website, such as chat, third party websites, forums, social media, newsgroups and/or apps, ABETEC has no control over, nor are we responsible for, the information you post thereon.
 

How do we secure your data?

Our employees are trained to handle confidential data correctly. Privacy-sensitive projects are also assessed in terms of security and the protection of personal data.
 
To ensure the security of your data, we employ specific individuals to ensure compliance with the law and our ethical aspirations. We also employ specialists who ensure the security of our network, infrastructure and information systems. In addition, we use a variety of technical measures to protect your personal information, such as: password protection, hard disk encryption software, firewalls, antivirus, intrusion and anomaly detection and access controls for our employees. If there is a data leak with unfavourable consequences for your personal data, you will be personally notified in the circumstances provided by law.
 
The number of our company employees who have access to your personal information is limited and carefully selected. These employees are granted access to your personal information to the extent that they need it to carry out their tasks properly.
 
The existence and content of the personal communications that pass through our network (e.g.: fixed and mobile telephone calls, e-mails and text messages) are protected by the provisions on telecommunication secrecy. This means that ABETEC and its employees may not become aware of the existence or content of such communications beyond the exceptions listed by law.
 
Our website or social media sometimes include links to third party websites (external websites, other social media, partner websites, event organisers we sponsor, etc.) whose terms of use do not fall within the scope of this privacy policy. Please read carefully their policy on the protection of your personal data.

We do not sell personal data to third parties, nor do we pass them on to third parties unless we do so:

  • To our successors in title. We will transfer your personal data to our legal successors and affiliates (such as subsidiaries and sister companies) for the same purposes as stated in this privacy policy.
  • This is necessary for our services. For some aspects of our products and services, we work with third parties or use subcontractors. Think, for example, of the storage of electronic invoices. Your data will only be passed on for the same purposes as ABETEC itself. We see to it that they, like us, manage your data securely, respectfully and with due care.
  • There is a legal obligation. There is a legitimate interest for ABETEC or the third party concerned. This only happens if your interest or fundamental rights and freedoms are not overriding.
  • You give us permission to do that. If ABETEC would otherwise provide personal data to third parties, this will be done by means of an explicit communication, in which an explanation is given about the third party, the purposes of the transfer and processing. Where required by law, we obtain your express consent. You also always have the opportunity to resist.

With regard to the international transfer of personal data, we protect your data in accordance with the level of protection required by European regulations.
In some cases, we use anonymous, aggregated data for commercial purposes or for external reporting. This data can never be traced back to a particular individual.

If we want to collect your personal data for specific purposes, we will always inform you about this, and where required by law, ask for your consent, in the communication we distribute about it.


What about the storage period?

Personal data processed for customer management purposes will be retained for the period necessary to comply with legal requirements (e.g. in the field of accounting).
 

What are your rights and how can you exercise them?

Right of access

At all times, you have (free) accesss to the data we have about you. You can ask us:

  • Whether we process your personal data;
  • For which we process them;
  • What categories of personal data we process;
  • With which categories of third parties we share your personal data;
  • What is the origin of the data processed; and
  • What logic do we use when we process certain personal data automatically?

You can exercise this right by means of the procedure below, which we call "Subject Access Request" or "SAR" on the basis of the legal terminology.
To do so, you must send an e-mail to privacy@abetec.be.
 
In order to exercise your right of access, and to prevent any unauthorised disclosure of your personal data, you must enclose proof of your identity (preferably a copy of the front of your identity card) with your application. ABETEC has 45 days to answer your request. Please note that this period will not begin until ABETEC has received your application in writing and has all the information required to comply with your application.
If you have any reason to believe that ABETEC has not handled your application correctly, please contact the ABETEC Managing Director at rvandamme@abetec.be so that we can look into the matter with you.
If ABETEC nv does not respond to your request, refuses it or if the response does not meet your expectations, you have the right to lodge a complaint with the Privacy Commission, at commission@privacycommission.be .

Right of rectification and disposal

You have the right to have incomplete, incorrect, inappropriate or outdated personal data removed or changed. You can contact us at privacy@abetec.be.
 
We will then amend or remove this information as necessary within the legally established time limits. Please note, however, that sometimes, depending on your request, we may no longer be able to offer you some services. Nor can we always remove all requested data, for example because we are legally obliged to retain certain data for certain periods of time.

Right to object to the processing of your data for direct marketing purposes

You always have the right to oppose the use of your personal data for direct marketing purposes. You can always contact ABETEC itself ( abetec@abetec.be ), or you can:
For commercial phone calls: subscribe to the Call me no more list (www.bel-me-niet-meer.be).
For commercial letters: register yourself on the Robinson list  (www.robinsonlist.be).
For commercial text messages: by responding with "STOP" to the number you sent the text message;
For commercial e-mails: via the unsubscribe option in the e-mail in question. To make email campaigns more efficient, we use software to measure whether our emails have been opened and which links have been clicked on;

Please note that we reserve the right to contact you by electronic means within the framework of the execution of your contract or if we are obliged to do so by law.

ABETEC takes care of appropriate organisational and technical measures to secure personal data. We may not retain personal data longer than necessary to fulfill the purpose for which we collect them. The storage period may therefore vary for different purposes. Sometimes the period may be long, for example to comply with our legal obligations (to meet our accounting and tax obligations, for example, we are obliged to keep invoice data for a maximum of 10 years) or because of the legal need to keep certain data as evidence in the event of litigation, for a maximum of 10 years after termination of your contract, or for 10 years as part of our claims guarantee. This archived data is of course only accessible to a limited extent.
 
At the end of the applicable retention period(s), personal data will be rendered anonymous or deleted.

 

What about our website, cookies and mobile apps?

In addition to the data you voluntarily share with us when using our website, we also use cookies and other technological means to collect data.

Website

You can visit our website without disclosing your personal data. With your permission (to the extent necessary), we can inform you as a visitor to our website about a personalised range of services. Some features or functions are reserved for visitors with an account. We then identify your anonymised IP address and link it to your customer data.

In order to optimise our services, we may further supplement your customer data with the data we derive from cookies as a result of your use of our website.

What are cookies?
We use cookies when you open our emails and/or when you visit our website or use an app. Cookies are pieces of information that are stored on your own computer or mobile device and that optimize the ease of use of our website and app. For example, you can be identified as a visitor to our website on your next visit and we can tailor our website or app better to your wishes, preferences and ease of use. Which kind of cookies do we use?
Indispensable cookies: are necessary to use the website and provide a secure identity check. For example: navigation on the website, access to personal data, ...

Functional cookies: make the functioning of the website easier and ensure a personalized browsing experience by remembering, for example, login names, passwords, the contents of your shopping cart, previously made selections and preferences - such as the language setting.

Analytical cookies: enable us to analyse our website. This way we know how many visitors come to our site, how long they stayed, what they clicked on, which parts are popular, and so on. We can also see which web pages are not well visited and which problems visitors encounter. This allows us to continuously improve our website. We also use third party cookies such as Google Analytics and Google Tag Manager for this purpose. The information generated about your usage behaviour on our website is collected anonymously (by deleting the last 8 characters of your IP address) and transferred to and by Google, where it is stored on servers in the United States. This anonymised data is then analysed by Google on our behalf and sent back to us as aggregated data. Google will not associate your anonymised IP address with any other data recorded by Google.

High-performance cookies: collect data from visitors in order to improve the website. For example: counting visitors, listing popular web pages, etc.

Ad cookies: customize ads based on your browsing habits, demographics and user data.

Remarketing cookies: our website uses remarketing cookies to display personalised and/or interest-based advertisements to you for a certain period of time (up to 90 days). For more information about these cookies; Google Remarketing (Adwords / Dynamic Remarketing), Linkedin and Facebook.

Profiling cookies: cookies that contribute to forming targeted messages on our website.

Other technological means

To measure and improve the success of our advertising campaigns, technologies such as web beacons and action tags count the number of visitors to our website and/or app following an advertisement on a third party site. Certain pages on our website also work with pixel tags. These pixels show, among other things, which services you are viewing on our website. On the basis of that information we can then show you relevant advertisements on, for example, Facebook and Google.

What are cookies used for?

Cookies can be used to recognise you when you visit ABETEC, remember your preferences and provide you with a personalised experience that matches your settings.
 
Cookies also make your interactions with ABETEC faster and safer. Thanks to cookies, we can also show you advertisements, both on and outside the ABETEC website, and offer you customised functions via plug-ins of ABETEC nv, such as our Share button.
